The legal battle for the soul of Osun PDP continued today in the High Court of Justice, Ikirun, Osun state.
After all appearances were announced, the defense counsels replaced their earlier filed applications and replaced same with a new one which was filed this morning.
The Applicant counsel said since the defendants counsels just filed their applications this morning and he has not been able to reply, he asked for extension of time to reply which eventually led to asking for adjournment.
The defense counsels asked for striking out of the interim order granted the applicant to resume as the validly elected chairman of PDP.
The counsels to the defendants argued that the interim order has expired immediately a motion for objection is filed against it and that it has only seven days but the counsel to the applicant asked for validation of the interim order because all the seven requests/prayers of his client were all considered and appeared reasonable because he was removed in abeyance to the provisions of the constitution of PDP.
The counsel argued further that the defense counsel failed to prove that the interim order has expired. He argued that the interlocutory interim order has not expired because Sunday is not part of the days being calculated to make it 7days
The judge said it is not possible to allow vacuum to exist in the structure of the party therefore converted the interim order granted Hon. Olasoji Adagunodo to a preservative order for him to continue to enjoy his status as the validly elected chairman of PDP in Osun state pending the determination of the motion on notice.
The case was adjourned till 25th November, 2020.
However, after the court session, the Chairman moved to the party Secretariat at Biket junction in Osogbo, only to meet closed doors as he did last week.
