An Ikeja High Court has dismissed a lawsuit filed by Mr. Joseph Aloba, the father of the late singer Ilerioluwa Aloba (popularly known as Mohbad), challenging a legal decision that cleared musician Azeez Fashola (aka Naira Marley) and music promoter Samson Balogun (aka Sam Larry) of involvement in his son’s death.

 

Mr. Aloba, represented by his lead counsel Dr. Wahab Shittu (SAN), sought to overturn the legal advice issued by the Lagos State Director of Public Prosecutions (DPP), which found no basis to charge the two men. The suit named both the Lagos State Attorney General and the DPP as respondents.

 

In her ruling, Justice Taiwo Olatokun stated that the Attorney General has full discretion over prosecution matters, and that such decisions are not subject to judicial review.

 

Shittu argued that the DPP’s advice violated the family’s right to a fair hearing and interfered with the ongoing coroner’s inquest into Mohbad’s death. He also claimed that key suspects were released prematurely.

 

However, the Attorney General and the DPP countered that the individuals were not acquitted but simply discharged, and that there is no legal obligation to inform the coroner of the DPP’s findings.

 

Justice Olatokun upheld the DPP’s decision and dismissed the case.
