The Federal High Court sitting in Osogbo has adjourned the hearing of the suit filed by reinstated local government chairmen and councillors of the All Progressives Congress (APC) seeking judicial clarification on their tenure of office till November 27, 2025.
The suit, marked FHC/OS/CS/147/2025, was instituted by Onibonokuta Saheed and seven others against the Attorney-General of the Federation and six others.
The claimants are asking the court to determine if they are entitled to a three year term starting from February 2025 and to rule on the Osun State Independent Electoral Commission (OSSIEC) acted lawfully by conducting fresh local government elections on February 22, 2025, while their tenure was still subsisting.
The dispute stems from the lingering controversy over local government administration in Osun State following the Court of Appeal’s February 10, 2025, decision reinstating the APC-elected council officials earlier removed from office.
At Monday proceedings, counsel for the claimants, Barrister Muhydeen Adeoye, filed a motion seeking to restrain the defendants from interfering with his clients’ functions pending the determination of the substantive case.
However, counsel representing the 3rd and 4th defendants, Barrister F. K. Labo-Popoola, the 5th defendant, Barrister Rachael Ojomi, and the 6th defendant, Barrister J. A. Ayanyemi, argued that they were still within the legally permissible time to respond to the originating summons.
Presiding Judge Justice Adefunmilola Demi Ajayi noted from the records that service had not been completed on all parties and directed the claimants’ counsel to ensure proper service before the next adjourned date.
Justice Ajayi, who had earlier pledged to ensure an expedited hearing of the matter, subsequently adjourned the case to November 27, 2025, for continuation of proceedings.
