
Joseph Aloba, the father of the late singer Mohbad (Ilerioluwa Aloba), has approached the Ikeja High Court, requesting the annulment of the legal advice provided by the Director of Public Prosecutions (DPP) regarding the murder investigation into his son’s death.
Aloba is acting on behalf of the Aloba family in the suit against Lagos State Attorney General Lawal Pedro (SAN) and DPP Dr. Babajide Martins.
Filed on March 13, 2025, the suit (marked ID/6197MJR/2025) seeks the court’s intervention to quash the decision to discharge and acquit several key suspects in Mohbad’s death, including Naira Marley (Abdulazeez Fashola), Samason Balogun Eletu (Sam Larry), Owoduni Ibrahim (Prime Boy), and Pere Babatunde.
These suspects were released on February 26, 2025, following legal advice from the respondents, despite their involvement being mentioned in the ongoing Coroner’s inquest.
Aloba’s motion, filed by his lawyer Dr. Wahab Shittu (SAN), asserts that the legal advice was issued prematurely and obstructed the Coroner’s inquest, which had yet to conclude at the time of the legal advice.
The suit highlights that the premature release of the suspects undermines the Coroner’s investigation, which remains unresolved and has yet to summon the implicated individuals to testify.
Aloba further claims that the legal advice interferes with the statutory duties of the Coroner’s Court, constituting an obstruction of justice and a premature resolution of the matter.
The court is urged to intervene, as the ongoing Coroner’s proceedings must not be prematurely influenced or undermined.
In his affidavit, Aloba emphasized that the premature legal advice risks compromising the integrity of the investigation into his son’s suspicious death. He is seeking the court’s assistance to ensure justice is served in Mohbad’s case.
