The Osun State High Court sitting in Osogbo has ordered the maintenance of status quo on the process of installation of the new Olaaresa of Masifa Ile pending the determination of a suit filed by the Alaake’s Compound, Lateru Ruling House.
The State Government of Osun had on Wednesday, announced Mr. Joshia Awolade as the new Olaaresa of Masifa-Ile among three others to fill vacant stools in their domains.
Meanwhile, the Alaake’s Compound of Lateru Ruling House had earlier instituted a case challenging the candidature of Mr. Joshia Awolade who doesn’t belong but claim to be part of the Lateru Ruling House.
In his ruling today, Justice Jide Falola of Osun State High Court, Osogbo ordered a maintenance of Status quo ante Bellum in respect of Olaresa of Masifa-Ile, Ejigbo Local Government area of the state pending the determination of the suit before the court.
The court documents sighted by InsightMedia read, “I have read through the Motion Exparte as moved by Learned Counsel for the Plaintiffs, which was strongly supported by the Learned Counsel to the 6th and 7th Defendants, T.S. Adegboyega Esq.
“On request Registrar, of High Court of Justice Ejigbo produced the three volumes of the case files. Pages 330-331 of the volume contains the reliefs placed before the Court by the Plaintiffs, while page 745 of volume 2 of the case file contain the Counter Claim of the 6th and 7th Defendants. It is obvious from the Claims and Counter Claims that the stool of Ola Aresa of Masifa is in dispute, and there are injunctive reliefs pending against the 2nd Defendant and his family. Based on that it is glaring that the 2nd Defendant is fully aware of the implication of these reliefs. Based on the above, I shall, instead of granting the Motion Exparte for injunction frontally, order that stastuquo as at the last sitting date held by my Learned brother L. O. Arojo Judge, on 27th May, 2022 be maintained pending the Hearing of the Motion on Notice which has been filed. The parties shall not proceed further that events that took place before the substantive Judge in this matter until the pending Motion on Notice is heard and determined.
“The Motion on Notice for Interlocutory Injunction, together with Enrolment this Order shall be served on all the parties forthwith.
“The return date in view of the urgency of the matter, is set at this day 1st September, 2022 for Hearing OF THE Motion On Notice for Injunction.”
With the new order, the court has therefore, set aside all the processes leading to the selection, nomination, appointment and installation of Mr. Josiah Awolade to fill the vacant stool of Olaaresa of Masifa-Ile.
