The loss at the polls is not enough to put an end to the legal battle in the Delta state chapter of the All Progressives Congress as a Federal High Court (FHC) sitting in Asaba on Thursday, April 4, nullified the APC’s governorship primary election conducted in Delta state.
The plaintiff Hon Victor Ochei, through his lawyer Ahmed Rahi, SAN, asked the court to declare that the APC’s gubernatorial primary election that held on Sunday, September 30, 2018, as illegal and unlawful on the ground that delegates unknown to the law were used for the exercise, Vanguard reports.
Justice Nnamdi Dimgba of the Federal High Court gave the ruling used in a suit marked FHC/ABJ/CS/1085/2018.
It will be recalled Emerhor faction of the Cyril Ogodo-led state executive had dragged the Ogboru/Omo-Agege faction of the Jones Erue-led Delta APC executive, Adams Oshiomhole, the APC National Chairman, and the Independent National Electoral Commission (INEC) to court over the conduct of the wards, local government areas and state congresses.
Among other prayers sought by the plaintiffs was a declaration that candidates that emerged from the primaries conducted by the Ogodo-led executive constitute the authentic list of candidates for the 2019 general election.
