The Federal Competition and Consumer Protection Commission (FCCPC) has issued a summons to the management of Air Peace Limited after receiving numerous complaints from passengers about the airline’s failure to issue refunds, especially in cases involving cancelled flights.
This development was confirmed in a statement released on Monday by Ondaje Ijagwu, the Commission’s Director of Corporate Affairs.
According to the FCCPC, the airline’s conduct may breach Sections 130(1)(a), 130(1)(b), and 130(2)(b) of the Federal Competition and Consumer Protection Act (FCCPA) 2018.
It stated that, “These provisions guarantee consumers the right to prompt refunds when services paid for in advance are not delivered due to the service provider’s fault. The Act emphasizes fair treatment and protects consumers from unjust and unreasonable practices.”
In a formal notice dated June 13, 2025, the FCCPC invoked its powers under Sections 32 and 33 of the FCCPA to summon Air Peace for a hearing at its Abuja headquarters on Monday, June 23, 2025.
The Commission also highlighted Section 33(3) of the Act, which mandates compliance and outlines possible penalties, including fines or imprisonment, for any defiance.
As part of its requirements, Air Peace is expected to provide specific documents, including: a record of all refund-related complaints received within the past year; documentation of all completed refunds so far; a full list of flight cancellations across all routes during the last 12 months; and an explanation of steps taken to mitigate the effects of those cancellations on customers.
This action is distinct from an earlier probe initiated by the Commission in December 2024, which examined allegations of excessive pricing for flight bookings.
In response to that earlier investigation, Air Peace filed a lawsuit to prevent the Commission from proceeding with the inquiry.
Despite this ongoing court case, the FCCPC reiterated its dedication to implementing the FCCPA and safeguarding consumers—particularly airline passengers—against exploitative and unfair commercial behavior.
