The Court of Appeal sitting in Akure has struck out an application filed by Prince Ali Afolabi seeking to restrain the Aree of Iree, His Royal Majesty, Oba Muritala Omotayo Oyelakin Oyekun III, from exercising the powers attached to the traditional stool.

Prince Afolabi had approached the appellate court requesting an order to prevent the monarch from presenting himself as the Aree of Iree and from appointing or installing traditional chiefs within the Iree community pending the determination of the dispute.

However, in its ruling, the Court of Appeal dismissed the application in its entirety, declining to grant the reliefs sought by the applicant.

The decision means that Oba Muritala Omotayo Oyelakin Oyekun III retains his position as the Aree of Iree and may continue to carry out the functions and responsibilities associated with the throne, including the appointment and installation of chiefs.
