Election Petition: APP wants INEC to conduct a fresh guber election over non inclusion name of party candidate

The Adamawa State Election Petition Tribunal sitting in Yola received a petition from Action People’s Party (APP) of Independent National Electoral commission, INEC, to not have included the name of her candidate in the last 9th Match Adamawa State gubernatorial election polls.

In their petition contained a prayer that will determined a fresh Governorship election be conducted for the office of the Governor of Adamawa State where the candidate of the petitioner would be included.

Counsels to the petitioner (APP),Barr. Obed Okwukwe Agu and Barr Oluchukwu Nweke filed in the petition in Yola under the tribunal chairmanship of the election petitions sitting in Yola, Adamawa State, Justice S. B. Akanbi who has promised to ensure speedy dispensation of justice.

APP in their petition want Rt Hon. Ahmadu Fintiri,Governor elect to be the first respondent,his deputy,Hon Crowther Seth to be the second respondent.

While People’s Democratic Party (PDP) and the Independent national electoral commission to be the third and fourth respondent respectively.

Counsels to complainers in a file case no: EPI/AD/EO/01/2019 based their ground and facts upon which the petition predicated that:

“The entirety of the Adamawa state Governorship elections is invalid by means of substantial non-complience with the provisions of the electoral Act,2010(As amended).

” The election is invalid by means of unlawful exclusion of Mr Bitrus Madeh as the valid candidate of the petitioner to contest the gubernatorial elections.

The Adamawa state governorship elections held on 9th March ,2019 were vitiated by gross violation of the mandatory provision of the electoral act ,2010 by the exclusion of the replaced candidate of the petitioner.”

APP complained that Mr Bitrus Madeh and Audu Zanda as its validly nominated and /or replaced Governorship and Deputy Governorship candidates for the Governorship elections held on the 9th March, 2019 were unlawfully excluded and is the bed rock of their petition.

They said their prayers is to determined that Adamawa State Governorship election held on 9th March ,2019 is invalid or avoided for substantial non-complience with the provisions of electoral act.
